Terms of Service

1. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use our marketplace. Agents and service providers must hold all required licences, certifications, and insurances and agree to provide evidence on request.

2. Platform use

You agree to use ELYMENT Realty for lawful purposes, not to interfere with platform security, and not to harvest or misuse data. We may suspend or terminate access where activity is deemed fraudulent, misleading, or in breach of these Terms.

3. Accounts and credentials

You are responsible for keeping your login credentials secure. Notify us immediately if you suspect unauthorised use of your account. Agents must ensure their team access is appropriately controlled and promptly revoke access when staff leave the agency.

4. Marketplace content

Listing data, suburb insights, and partner offers are provided for general information only. We make reasonable efforts to keep data current but do not warrant completeness or accuracy. Always obtain independent professional advice before making property decisions.

5. Fees and payments

Pricing for conveyancing, finance, renovation, or trades services is indicative and excludes government charges, third-party disbursements, and GST unless stated. We will provide a tailored scope of work and fees before you authorise any paid service.

6. Liability

To the maximum extent permitted by law, ELYMENT Realty Sydney is not liable for indirect or consequential loss arising from platform use. Our liability for services cannot exceed the fees paid to us for the relevant service. These Terms do not exclude guarantees that cannot be excluded under the Australian Consumer Law.

7. Third-party services

Our platform integrates with conveyancers, lenders, trades, and other professional networks. Their services are subject to their own terms. We are not responsible for loss or damage caused by third-party acts or omissions, but we vet partners for compliance and service quality.

8. Intellectual property

All content, branding, and software remains the intellectual property of ELYMENT Group or its licensors. You may not copy, reproduce, or commercialise materials without prior written consent.

9. Termination

We may terminate or suspend access immediately if you breach these Terms. You may close your account at any time by contacting our support team. Certain obligations such as confidentiality and indemnities survive termination.

10. Changes to these Terms

We may update these Terms from time to time. Continued use of the platform after an update constitutes acceptance of the revised Terms. We will publish the latest version on this page with the effective date.
